Trump and others around him spin on the Supreme Court 9-0
ruling on Texas AG Paxton’s case is as weak as Abe Lincoln once told an
opponent about his argument in a Senate campaign debate was weak and when the
challenger rebutted asking “how weak,”
Lincoln said: “As weak as soup made by boiling the shadow of a pigeon that had starved
to death.”
Trump’s election fraud spin is 1,000 times weaker than that
soup, cite these recent points in
the Washington Post with this short introduction (with my editing to fit the blog) re: the SCOTUS ruling.
That ruling by the Supreme Court on Friday night (December
11) delivered was widely expected to be a significant rebuke of Trump’s effort
to overturn the 2020 election, and it was.
In a brief statement, the court (9-0) dismissed the case that Trump had called “the Big One.” It said those who brought the case from Texas
AG Ken Paxton (R), GOP leaders in 18 other states, and 2/3 of the GOP members in
the House (who signed on in support), all lacked the necessary standing for the
court to even consider the case.
Trump, et al
rebuttal points:
1. The court made no ruling on the merits of the
suit — that they essentially punted on a technicality — and that this means the
claims could still have merit.
2. That the dissents of Justices Samuel Alito and
Clarence Thomas suggest there was some merit. Indeed, some
have even hailed Alito and Thomas as heroes, in contrast to the three
Trump-appointed justices who declined to take a stand.
W/H Press Secretary Kayleigh McEnany summarized the former point while on Fox News and said: “There’s no way to say it other than they dodged. They dodged, they hid behind procedure and they refused to use their authority to enforce the Constitution. This was on standing, dismissed on standing and none gave a view on the facts of the case.”
Trump on Saturday morning retweeted an idea that Alito’s and Thomas’s
dissents rendered them defiant defenders of his rightful election saying: “Thank you, Justice Alito. Thank you, Justice
Thomas.”
Then Trump retweeted Sean Hannity saying: “Justices Alito and Thomas say they would have allowed Texas to proceed
with its election lawsuit.”
Trump himself proclaimed: “Never
even given our day in Court!”
Oops, actually he was
given his day in court that is now part of the string of his never-ending court
case losses.
There was some confusion Friday night with some critics of Trump’s legal strategy suggesting the two justices had participated in his effort to undermine democracy.
Also, plenty besides Trump and those he quoted
hailed the justices. The two justices’ dissents, though, are considerably less
significant than all that.
Justices Alito and Thomas simply echoed their long-standing positions regarding the court’s “original jurisdiction” which means it must accept such a case involving conflicts between states.
Their dissents were merely a matter of course for those two – something they have done before, but not with any kind of commentary on the substance of the claims.
In layman’s terms
Alito said, and Thomas agreed: “I
would like to hear the case, but would not grant relief other than that.”
Indeed, Alito actually made a pretty significant statement about the substance – but not in Trump’s favor. It reads: “I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue.”

My 2 cents: Pretty clear that Trump will never give up – never in his lifetime – he can’t lose or be accused of losing at anything he does, period.
This will haunt him every single day of his remaining life and he will
keep it in the public eye every single day if not weekly – wait and see.
What a pitiful man – a disgrace
to the human race and blot on our proud nation to have taken us this low point of
disgrace in the eyes of the world – that is a fact.
Trump loves to brag on and about himself; okay
brag about dragging us to the lowest point in all of American history, Mr.
Trump. Then jump with joy about that achievement – or again as Rick Perry would say: Oops...!!!
