Judge Cannon Legal Test: She Comes Across as Judicial Novice Out of Touch with Realty

It is time for Special Prosecutor Jack Smith to have Judge Aileen Cannon removed from this classified documents case.

That statement come from former 30-year Federal prosecutor, Glenn Kirschner, who wrote on X (formerly Twitter) that Smith should seek Cannon's removal from the case. 

He wrote precisely:Jack Smith literally and figuratively lays down the law. The disqualification bucket runneth over, and it's time for a motion to remove Trump-appointed Judge Aileen Cannon from presiding over a case involving a defendant to whom she owes her job.” (Note: Kirschner has been a frequent critic of Trump).

Cannon is overseeing the case in which Trump is accused of illegally retaining classified documents, hoarding them at his Mar-a-Lago resort in Florida and obstructing attempts by federal officials to retrieve them.

The former president has pleaded not guilty to the charges against him. He has denied any wrongdoing in the case and has claimed that the documents he retained were personal and he had right to them.

In a key court filing on Tuesday *April 9* Smith strongly criticized Cannon's proposed jury instructions in the Trump trial, which would allow a jury to decide that Trump was legally entitled to keep them under the Presidential Records Act (PRA) as personal items.

Pam Keith, Esq, CEO of the Center for Employment Justice and who attended the 2020 convention as a Biden nominee, said that Cannon has no future as a judge if Biden is re-elected. She also wrote on X that Aileen Cannon is angling for a [Supreme Court] nomination, and added: “She has a PERSONAL stake in helping Trump avoid conviction, and is doing her level best to curry his favor. She has ZERO future if Biden wins.”

Ty Cobb, former Assistant U.S. Attorney in MD and a former White House lawyer in the Trump administration, said that an appeal court will take Cannon off the case saying that Smith's court filing this week, in which he strongly objected to Cannon's proposed jury instructions, signaled that he is preparing to seek her removal. 

Then later speaking on CNN’s “OutFront” program, Cobb said that prosecutors are prepared to take an appeal to the 11th circuit in Florida if Cannon continues to rule against them, adding: They'll be in a position to take her up to the 11th Circuit. And I think the 11th circuit will likely take her off the case.”

Cobb concluded:Cannon has not been impartial in the case. Her incompetence is so gross that I think it clearly creates the perception of impartiality – of partiality, and her attempt to put her thumb on the scale. So, I think that should disqualify her. Many legal commentators have tried to be polite about Judge Cannon's missteps here and suggesting that they relate somehow to her inexperience or incompetence. I think the evidence of her bias is pretty palpable at this stage of the game.”

My 2 Cents: This classified documents case is the most-serious of all the charges and cases pending against Trump for these several reasons: (1) What are the unaccounted documents subject matter; (2) Where are those documents now; (3) Who possibly has them; and (4) Why do they have them (the reason)?

I had a Secret clearance from 1961-1973 and that was upgraded to Secret (SCI) from 1973 right until today that I still have kept all these years since my various Marine Corps duties and then other DOD & government-related positions. Even though I’m now retired the T/S (SCI) clearance still holds after a short and simple routine update.

For me this case has great personal concern about Trump keeping and mishandling those T/S (SCI) documents before, during, and after his presidency as outlined above. I know how sensitive the information can be. 

This case should be the #1 major concern of every voter in November as well … just image he gets back in the White House with a clear record of “absolute immunity” that SCOTUS is now considering to grant to him. 

I cannot personally comprehend that happening or if it were, what would it mean for our national security and status and safety as a trustful and great nation and ally for our friends today? 

My best guess it all would be in the toilet and so would we as a free democratic nation. That must never ever happen. 

I don’t understand one bit why Judge Cannon cannot see that and schedule a trial date for Trump to show the public and the world what justice is and means, and that in America “No one is above the law,” and especially in this extremely and most-serious case.
