Trump wants DC indictment to be dismissed for January 6
since he was president then and had “absolute presidential immunity” as covered
in this breaking story from MSNBC with this headline:
“Trump asks to dismiss D.C. election interference charges, citing presidential
immunity”
Trump on Thursday (October 5) asked a federal judge in Washington,
D.C., to dismiss his indictment on election interference charges. His attorneys
claim Trump is “absolutely immune from prosecution.”
Trump emphatically denies the indictment from S/C Jack Smith
charging him with conspiring to overturn his electoral loss to President Joe
Biden in 2020.
Trump's lawyers argued in their 52-page motion to dismiss the case in U.S. District Court in Washington: “He is absolutely immune from prosecution.”
Further, Trump’s attorneys said: “He emphatically denies Smith's
four-count indictment charging him with conspiring to overturn his electoral
loss to President Joe Biden in 2020.”
This is breaking news. Please check back for updates.
My 2 Cents: Wow – talk about reaching for straws – this takes the
proverbial cake. Need I remind anyone of this background article:
“Faithful Execution and
Article II,” a Harvard Law Review article
by Professors Andrew Kent, Ethan Leib, and Jed Shugerman, was cited in a
112-page opinion from U.S. District Judge Amit P. Mehta that rejects former
president Donald Trump’s claim of “absolute immunity from lawsuits regarding
inciting violence and the insurrection on January 6, 2021” – two cites below:
(1) The Washington Post article is here.
(2) Judge Amit Mehta’s opinion is here.
Why didn’t Trump and his legal
team remember that? So, ow about a big Rick Perry 2016 oops?
Thanks for stopping by.
