The DOJ
has asked the FEC to
stand down and wait to enforce action against Santos while prosecutors conduct
a similar criminal investigation.
Santos was elected to Congress in November after flipping NY’s
3rd Congressional District. He is under extreme scrutiny and several federal
investigations related to lying about his biography, including his educational
background, work experience, and finances.
Two people told the Washington Post that the DOJ had asked the FEC to provide them with any relevant documents that can be used for the investigation.
The DOJ has not announced
a criminal investigation into Santos, though Friday's report is the clearest
sign the embattled congressman might be facing more severe penalties than
sanctions in Congress.
Brett Kappel, a campaign finance lawyer at the DC-based
Harmon, Curran, Spielberg & Eisenberg, also told
the Washington Post: “The request, which came from the DOJ’s Public
Integrity Section, indicates that there's an active criminal investigation that
overlaps with complaints filed with the FEC.”
Santos is facing investigations from a variety of federal and state entities. He is under an ethics investigations into his finances after Reps. Dan Goldman (D-NY) and Ritchie Torres (D-NY) filed a complaint to the House Ethics Committee in early January. They requested the committee look into his campaign's financial disclosure reports.
Most recently, Reps. Joseph Morelle (D-NY) and Gregory Meeks
(D-NY) also wrote a joint letter to Speaker Kevin McCarthy (R-CA) focusing on
Santos's alleged campaign donations from sanctioned Russian
oligarch Viktor Vekselberg. They also called on McCarthy to prevent
Santos from accessing any classified Congressional information pertaining
to national security during these investigations.
The SEC also has interviewed
people regarding Santos's role in Harbor City Capital, an investment firm accused by
the SEC of being “a classic Ponzi scheme.” (That SEC report is here).
If found in violation of
campaign finance laws, both McCarthy and Rep. James Comer (R-KY) said Santos
will be removed from Congress.
On the other hand, Republicans like Rep. Matt Gaetz (R-FL)
have stated: “While Santos will undergo investigations, he should not be shunned by fellow Congressional leaders.
My 2 Cents: First, this for Matt Gaetz and anyone else who holds that same view: Just shut the hell up.
I doubt whether Gaetz or McCarthy, et al
can even spell leadership let alone know how to lead.
Santos based on tons of public
information and lies right now should be expelled from Congress ASAP. And, shame
on the GOP for sticking by Santos the way they are – mostly for raw politics
and nothing else; certainly nothing based on any principle.
Finally, I wonder where Santos was born. Maybe not in the U.S. If he was born outside of the U.S. were his parents U.S. citizens, and or when did he become a U.S. citizen?
If none of that is true, then he is serving unlawfully in Congress by violating this constitutional qualification standard: “To be elected, a representative must be at least 25 years old, a United States citizen for at least seven years, and an inhabitant of the state he or she represents.” (Ref: U.S. Constitution, Article I, section 2, clause 2).
(Note: To be a Senator in a similar case: Age is 30 and citizenship is for 9 years).
